Course Description:
Studies business reorganization under Chapter 11 of the Bankruptcy Code after a brief foray into consumer bankruptcy. Addresses issues as they would arise in a Chapter 11 reorganization case from the moment a Chapter 11 petition is filed to confirmation of a Chapter 11 plan. Students planning to practice business law should consider taking this course because proper structuring of a deal at state law requires understanding the bankruptcy implications if one of the parties subsequently encounters problems. Explores strategies for the debtor, unsecured creditors, and secured lenders in the context of analyzing cases and problems in light of the Bankruptcy Code.
