Trade Secret Law

Course Description:

Addresses if and why the state should protect trade secrets; when information is entitled to protection as a trade secret; what constitutes the “misappropriation” of trade secrets and victims’ remedies; how courts balance the “rights” of firms to protect their trade secrets and the “rights” of former employees to work in their fields; when and if courts should enforce noncompetition agreements; if courts should enjoin individuals from taking certain jobs based on the “theory” that they “inevitably” will disclose their former employers’ secrets; if civil trade secret law should be federalized; why the federal government has criminalized trade secret theft; and how federal law impacts state trade secret law. Requires students’ participation in class discussions and preparation of a brief.
