Course Description:
Surveys legal doctrines, techniques, and institutions relating to regulation of the use of real property. Coveres constitutional questions of takings by public agencies, the scope of the police power as it affects land use, and the basic techniques of zoning and subdivision control. Students study, among other issues, recent cases on exclusion of low-income housing, current techniques to encourage housing development (inclusionary or “linkage” regulations), and First Amendment questions arising from land-use controls.
